TERMS AND CONDITIONS FOR COMPAQ MY BHASHA QUARTERLY DRAW (“DRAW”)
OFFICIAL DRAW RULES
Note: this Draw is not applicable in Tamil Nadu
DRAW: The Draw is organized and conducted by FTK Technologies Ltd. (“the Organizer”)
1. In order to participate in the Draw, each Participant (the “Participant”) must send his Unique COMPAQ MY BHASHA Product ID (“Product ID”) through the e-mail to support@lookeys.com along with his full name.
2. At the first week of each calendar quarter a draw shall take place at the Organizer offices in which one (1) Unique Product ID’s from all already produced COMPAQ MY BHASHA Product ID’s shall be randomly selected as the winning Unique Product ID’s (“Winning Product ID”) for this particular month.
The Winning Product ID can be reselected (randomly) in the following months.
3. Quarterly Winner: Should the holder/owner of the Winning Product ID have sent the email with his Product ID to support@lookeys.com prior to the specific draw he/she shall be declared as the “Quarterly Winner”.
In the case that no one has sent the Winning Product ID prior to the specific draw, there shall be no Quarterly Winner.
4. No purchase is required in order to enter this draw.
5. DRAW PERIOD: The next quarterly Draw shall happen on July 2010. Organizer may terminate the Draw at any time, for any reason or for no reason, with or without previous notice.
6. The prize (the “Prize”) is a new 32” LCD TV which shall be supplied by the by LCD TV dealer to customer address within 30 business days. Shipment costs are included in the prize.
7. The Quarterly Winner shall receive the Prize.
ELIGIBILITY AND CONDITIONS:
1. Participants must be citizens of India residing in India (Except for Tamil Nadu region). Residents of other countries and non-citizens of India are not eligible to participate.
2. By participating in the Draw, each Participant agrees to follow these Official Draw Rules and to be bound by any decisions made by ORGANIZER including any interpretations of these Official Draw Rules.
5. Organizer, his affiliates and subsidiaries, and their respective agents and representatives, are not responsible for any loss of entries for any reason whatsoever including, due to any problems caused by e-mail transmissions problems, for entries received after the deadline as a consequence of telephone or computer service delays, interruptions, failures or overloads, or for lost, misdirected or misplaced entries. Entries are void if unreadable, inaccurate, incomplete, damaged, tampered with, falsified, mechanically reproduced, irregular in any way or otherwise not in compliance with these Official Draw Rules.
6. The e-mail address will be used to identify the Participant as a unique identification.
7. The Organizer has right to select and declare or not to declare the Prize Winner. Decision of Organizer in all matters pertaining to the Draw is final and no correspondence in this regard will be entertained.
8. The Quarterly Winner will be notified by e-mail and must confirm acceptance of the Prize immediately with ORGANIZER. If ORGANIZER does not receive an answer from the Quarterly Winner within One (1) week after initial contact is made by ORGANIZER, the Quarterly Winner will be disqualified.
Quarterly Winner shall be announced on Compaq My Bhasha Home Page, as well, immediately thereafter. ORGANIZER and its agents, affiliates and representatives will use their best efforts to contact the Quarterly Winner, but will not be responsible or liable in any way whatsoever if the Quarterly Winner cannot be reached by e-mail within the one week. The Quarterly Winner does not become official until all entries are validated.
The Quarterly Winner must present valid identification with proof of age, ownership of the Unique Product ID Numbers of the Draw and his/her residential address to ORGANIZER or its designated representative in order to claim the Prize.
While accepting the Prize, the Quarterly Winner is required to sign an Indemnity and Release of Claims form provided by ORGANIZER, which shall release ORGANIZER of all liability.
Failure to complete and sign any documents requested by ORGANIZER may result in disqualification of the Quarterly Winner. All decisions of ORGANIZER are final and irrevocable.
9. The Quarterly Winner does not become official until all entries are validated by the Organizer.
10. The Prize will be awarded to the Quarterly Winner pursuant to verification and in accordance with these Official Draw Rules. In case of Quarterly Winner below the age of 18 years, the Prize may be awarded to the Quarterly Winner’s parent or guardian only after verification by the Organizer.
11. All taxes, levies and duties due and owing under applicable and statutory laws in connection with the Prize, and all other costs, including insurance, incidental costs, gifts, gratuities and taxes are the sole responsibility of the Quarterly Winner.
12. The Prize shall contain standard warranties as provided by the manufacturer. ORGANIZER does not provide any additional implied or express warranties or guarantees in respect of the Prize provided by the Organizer. Any malfunction or product defect of the Prize shall be taken up directly by the Prize Winner with the Organizer.
13. The Prize cannot be transferred, negotiated, refunded or exchanged, and by no means will cash be given. Only the Quarterly Winner, and not any other person or agent, may claim the Prize.
14. Organizer is not responsible for any errors or omissions in the terms and conditions contained herein. All information provided in the Draw is provided "As is" without warranty of any kind. ORGANIZER makes no representations and disclaims all express, implied, and statutory warranties of any kind to the Participant and/or any third party including, without limitation, warranties as to accuracy, timeliness, completeness, merchantability, or fitness for any particular purpose.
15. By entering the Draw and accepting the Prize, the Quarterly Winner waives all copyrights, rights of publicity and any related rights and consents to Organizer’s right to picture, tape or portray him/her as a Draw winner, and to exhibit this material in any and all media now existing or hereinafter created, including without limitation television, film, radio and print media without any compensation whatsoever for advertising and publicity purposes, except where prohibited by law.
The Quarterly Winner also consents to the Organizer’s right to use his/her name, voice or picture, or the content of his/her Draw entry.
16. Participants release the Organizer of the Draw and their respective divisions, affiliates, subsidiaries, branches, directors, officers, employees and agents, as well as all others associated with the development and execution of this Draw, from and against any and all liability with respect to or in any way arising from this Draw and the awarding and use, misuse or possession of the Prize, including liability for personal injury, except where prohibited or limited by law.
17. ORGANIZER reserves the right to change the conditions of this Draw and to alter or terminate the Draw at any time without prior notice.
18. The Draw is void where prohibited by law. All relevant national and local laws apply. All disputes to be settled within the jurisdiction of the Courts in Delhi city only.

20. For a copy of these Official Draw Rules, or in case these Official Draw Rules are not clear, the Participant may contact the aforesaid address specifying a request. However no queries will be entertained on the result of the Draw.
21.Under no circumstance, shall the Organizer and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the Participants and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever. The Participant specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Organizer and/or their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Draw.
22. The Draw shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Draw are subject to the jurisdiction of the Courts at Delhi only.
23. Your participation in the Draw by sending entries through e-mail will be construed as an acceptance of the above stated terms and conditions and you agree to be bound by any decisions, made by the Organizer, including any interpretation of these Official Draw Rules
